How to ensure your building complies with fire safety

All buildings must comply with England's Building Regulations formed in 2010. For a property to be accepted by building regulators, they must:

  • Provide a means of warning and escape — escape routes, suitable areas for evacuation or rescue, fire windows, fire escape ladders, etc.
  • Install fire detection and alarms — smoke detectors, alarm systems, fire detection systems, etc.
  • Use materials to prevent the spread of fire — building materials that will hinder the spread of a fire, or lower the rate of heat release.
  • Create a structure that contains a fire — ensure the elements withstand a fire, contain a spread to neighbouring buildings, and reduce the risk of collapse.
  • Provide a roof to a block of flats — build a roof only if it allows a means of escape to visitors or tenants such as external stairs.
  • Install extinguishing systems in flats — provide sprinklers in individual flats, fire dampers, and ventilation systems.
  • Design a building to aid emergency services — provide reasonable facilities to assist firefighters, or allow easy access during a fire.

Who is liable for fire damage: the tenant or the landlord?

Knowing that your landlord must ensure your rental home is fire-safe is crucial for tenants. If, on the other hand, the tenant proves to be negligent and responsible for a fire, they may be held accountable for the damage and charged for repairs and fire damage cleaning services.

This might also imply that the tenant is not entitled to replacement or compensation for any lost or damaged items, and rent may be paid regardless.

However, if a fire is due to the landlord's neglect, such as defective wiring or inadequate safety measures, the tenant is not liable. In this instance, the landlord is responsible for repairing or replacing any damaged items, and paying for any cleaning services required.

If neither party is at fault, both the landlord and the renter must bear the cost of repairing and replacing their property. However, the landlord is still responsible for fixing and cleaning the property as needed to maintain the tenant's safety and habitability.
